ARSON CASE

He represented a college student accused of intentionally setting a fire in a dormitory at San Jose State University that resulted inserious burns to twenty students, includingone student who had burns over half of his body. At the conclusion of the preliminary examination in which his client was charged with arson, all charges were dismissed. 



CRIMINAL TRADE SECRET CASE

He represented a former IBM engineer who was prosecuted for trade secret theft from IBM. This was only the second prosecution of the then new California criminal statute. He represented the former IBM engineer throughout the pretrial proceedings, taking the issue of the constitutionality of the trade secret statute to the United States Supreme Court. 



DOCTOR OVERBILLING MEDICAL AVOIDS JAIL

A doctor was alleged to have overbilled MediCal hundreds of thousands of dollars for services that were not performed. A number of motions were litigated and while the case was pending, the prosecutor filed another criminal case alleging additional instances of overbilling. Nonetheless, Guyton Jinkerson was able to negotiate a probationary sentence in which the client avoided jail. 




DOCTOR WHO RECKLESSLY DISPENSED PRESCRIPTION DRUGS AVOIDS A PRISON SENTENCE

The client was a doctor who on numerous occasions failed to follow well documented restrictions on prescribing Oxycontin and other prescription medications. One of her patients died within a few days of receiving a prescription for a large quantity of Oxycontin. After five years and a number of hearings and evidentiary proceedings, Guyton Jinkerson was able to resolve the case for a probationary
sentence.




DOCTOR INVOLVED IN A MEDICARE KICKBACK SCHEME AVOIDS JAIL 

A doctor was alleged to be engaged in receiving numerous kickbacks for referrals to home health care agencies. After protracted negotiations, Guyton Jinkerson was able to structure a resolution that allowed the doctor to avoid confinement. 




ENVIRONMENTAL CRIMES 

The client had what amounted to an obsession with collecting a vast number of endangered species in violation of various state and federal protections. The client was able to avoid confinement for the offenses as Guyton Jinkerson was able to present persuasive arguments at the sentencing hearing.



SECURITIES FRAUD

The client was a significant investor in the public offering of an internet shopping business. Once the common stock went public, there was unusual and suspicious stock trading activity that caused the Securities and Exchange Commission to initiate an investigation. The client was vigorously represented during the investigation and did not suffer any adverse consequences.




ANTITRUST CRIMES

The client was a very prosperous investor who became involved in a joint venture to bid on foreclosed real estate. Unbeknownst to the client, his partner in the joint venture was involved in a wide-ranging conspiracy to manipulate the bidding at the real estate auctions. Although the client’s partner was indicted on antitrust violations and convicted at trial, Guyton Jinkerson was successful at persuading the government not to pursue his client.




ACQUITTED OF CHILD ABUSE


He took over a case where a woman had pleaded guilty to child abuse and agreed to a sentence of five years in prison. She was married and had two small children. Guyton Jinkerson presented a comprehensive motion and protracted evidentiary hearing to withdraw the plea which was successful. Thereafter, the case was tried and she was acquitted. 



RAPE CHARGES DISMISSED


His client offered shelter to a runaway girl and then allegedly raped her. At the trial, evidence was presented that the client had engaged in similar conduct with another woman. After two trials where the juries could not reach a result, the case was dismissed.



FOUND NOT GUILTY OF RAPE

After a night of partying with several women, the client was alleged to have raped one of the women. The client was found not guilty by a jury.




CLIENT ACQUITTED OF A HOMICIDE

He represented an individual who had been taunted with racial epitaphs and then assaulted. The client defended himself and the perpetrator died during the altercation. Guyton Jinkerson argued in trial that the client was defending himself and the jury returned a verdict of not guilty.




CLIENT FOUND NOT GUILTY OF TWO MURDERS

He represented an individual who shot and killed a father and son in the parking lot of a bar. Guyton Jinkerson argued that the shooting of the son was justified as it occurred in the defense of a third party and the shooting of the father was excused as self defense. The jury agreed and the defendant was acquitted of both alleged murders. 




FATHER SHOT, SON SHOT AND KILLED, CLIENT ACQUITTED

A father was shot and his son killed in a trailer on the grounds of a business in San Jose, California. Since it was alleged to be a Mafia hit, there was widespread publicity that caused the case to be tried in Los Angeles County. Three of the defendants were initially tried in a proceeding that lasted eighteen months and Guyton Jinkerson’s client was the only one acquitted.




ALL CHARGES DISMISSED BY THE COURT DURING MURDER TRIAL

He represented the defendant who organized a conspiracy that resulted in the death of an acquaintance’s husband. The defendant confessed in a detailed statement to the police. Guyton Jinkerson was successful in excluding the confession and all charges were dismissed in trial. The remaining three defendants were convicted of murder.




CASE WHERE THE DEATH PENALTY WAS SOUGHT, DISMISSED

He represented an individual who hired two men to kill his wife. The two men approached his wife while she was seated in a motor vehicle and shot and killed her with a sawed-off 12 gauge shotgun. All three individuals were charged with murder and the death penalty was sought. At the preliminary examination, Guyton Jinkerson was successful in excluding incriminating evidence and all charges were dismissed against his client. Both of the other defendants were convicted of first-degree murder and one of those defendants was sentenced to death. 




MURDER CHARGES DISMISSED

Guyton Jinkerson’s client furnished amphetamines to a woman who died shortly after ingesting the drugs. The client was charged with murder. Guyton Jinkerson was successful in having a motion to dismiss the murder charges granted.



CLIENT FOUND NOT GUILTY OF MURDER AND SPARED FROM THE DEATH PENALTY

He represented an individual who was charged with premeditated murder where the defendant had been previously convicted of another murder and was facing the death penalty. After a lengthy trial, the defendant was found not guilty.



SAVED FROM MURDER CONVICTION

He was successful at having a murder conviction set aside where a defendant had been convicted of murder in a trial where the defendant’s former lawyer reduced the proceedings to a sham and a farce. In the retrial conducted by Guyton Jinkerson, the defendant was convicted of involuntary manslaughter and gained his freedom.



NO CHARGES FILED IN DOUBLE HOMICIDE 

In 1988, Guyton Jinkerson represented an individual under investigation for shooting and killing two unarmed men. No charges were filed.




ACQUITTED OF MURDER CHARGES

He represented an individual who had aided and abetted his stepson in murdering the stepson’s bride for financial gain. In trial, the stepson was convicted and a sentence of death was imposed. Guyton Jinkerson’s client was acquitted in a separate trial.




NO CHARGES FILED IN MURDER INVESTIGATION

In 2007, he represented an individual who was the suspect in a murder that occurred at a dance club in Palo Alto, California. No charges were filed.



GROSSLY NEGLIGENT MANSLAUGHTER CONVICTIONS AVOIDED

Between 2018 and 2021, he represented an individual charged with gross vehicular homicide where the client struck and killed a California Highway Patrol motorcycle officer and the individual who he was citing for a motor vehicle violation. Within days of the deaths, charges were filed based on the allegations that the client was speeding and distracted while driving. After substantial investigation and preparation, on the first day of trial the case was resolved for misdemeanor manslaughter pleas and a probationary sentence.
